An Agency Issue? The Legal Nature of the Credit Servicing Agreement

The Directive on Credit Servicers and Credit Purchasers has introduced two new contracts in European private law. The legal nature of these contracts is not certain, which could lead to various interpretations in national laws and undermine legal harmonisation efforts. The project aims to clarify these contracts' legal nature and help resolve potential confusion in their implementation.
